Event Terms & Conditions
These terms apply to your purchase of tickets to, and your participation in, the NZ House & Garden Tours (the “Tours”), which are organised by Stuff Limited (“Stuff”, “we”, “us” or “our”). In these terms “you” and “your” mean the person buying the ticket and, where the context requires, each Tour goer.
By buying a ticket or attending the Tours, you agree to these terms. Please read them carefully and keep a copy.
1. Tickets and changes to these terms
a) Tickets are subject to availability and are sold on a first-come, first-served basis through www.nzhouseandgardentours.co.nz. Tickets purchased through any other channel may not be valid for entry.
b) We may update these terms from time to time. The version published on the Tours website at the time you buy your ticket applies to that purchase. We will publish any material changes on the Tours website.
c) We may change or modify any part of the Tours, including the date or location, at any time. We will publish details of significant changes via the Tours website, e-newsletters and other reasonable means.
2. Health, safety and the risks of attending
a) The homes and gardens on the Tours are private properties that are not designed as public venues. Please consider the following before you buy a ticket and before you attend.
b) You confirm that you are not aware of any illness, injury, disability or other condition that attending the Tours could make worse, or that could put you or others at risk.
c) Like any visit to private homes and gardens, the Tours involve risks that you should be aware of. These include, but are not limited to:
uneven or slippery ground and surfaces, steps, ruts, holes, rocks and similar conditions in and around the homes and gardens;
the risk of catching a communicable illness from other people present; and
equipment on the Tours being misused, breaking or malfunctioning.
d) We take the health and safety of everyone at the Tours seriously and will take reasonable steps to manage risks. You play an important part in keeping everyone safe. You agree to follow all safety instructions and signage, to follow the reasonable directions of our staff and volunteers, and to take reasonable care for your own safety and that of others. Tour goers are not individually supervised, so please take care of yourself and anyone you are responsible for at all times.
3. Our liability to you
a) Nothing in these terms limits or excludes any liability or obligation that cannot lawfully be limited or excluded, including our duties under the Health and Safety at Work Act 2015, or your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
b) Because the Tours are services supplied to you, where you acquire a ticket as a consumer the guarantees in the Consumer Guarantees Act 1993 apply and are not excluded.
c) Subject to clause 3 and to the maximum extent the law allows, Stuff is not liable for loss or damage arising from your attendance at the Tours, other than loss or damage caused by our negligence or wilful default. Any conditions and warranties implied by law are excluded only to the extent the law permits them to be excluded.
d) You decide whether to attend, and you are responsible for your own choices and conduct during the Tours. To the maximum extent the law allows, you are responsible for any loss or damage you cause to a home, garden, property or person during the Tours, including as a result of your breach of these terms or your failure to follow reasonable instructions from our staff or volunteers.
4. Tour rules
a) The Tours take place in people’s private homes. You must be respectful and follow all reasonable instructions given by our staff and volunteers, and observe normal road rules.
b) To protect the homes, no shoes may be worn inside the houses. If you have a medical need to keep your shoes on, please tell us in writing by 5:00pm (NZT) on the Wednesday before your tour date. In that case you must wear shoe covers over your shoes; we will not provide these.
c) To protect the homes, walking sticks, wheelchairs, walking frames, mobility scooters and other mobility aids, prams, and any other equipment that could cause injury or damage are not permitted inside the houses. Please contact us before the Tours if you have accessibility needs so we can discuss what assistance we can offer.
d) Because of the private nature of the homes, no dogs are permitted on the Tours. If you rely on a disability assist dog, please contact us before buying a ticket so we can discuss your needs.
e) Taking photographs or video inside the homes, and flying drones or other unmanned aerial vehicles, is not permitted without our prior written authorisation, which we may give or withhold at our discretion.
f) As a condition of entry to some homes, you and your belongings may need to be searched on entry or exit.
g) We may refuse entry to, or remove, any Tour goer who: behaves inappropriately, offensively or abusively; risks damaging property; the home owner reasonably (in Stuff’s assessment) requests exclusion; needs to be removed on medical or health and safety grounds; or engages in unauthorised marketing, including ambush marketing. We may also reject or cancel attendance for safety or insurance reasons. We are not obliged to refund the ticket price where we do this because of your conduct or breach of these terms.
5. Medical assistance
a) If you are injured, become unwell, or have an accident during the Tours, you consent to receiving any medical aid or preventative treatment that the Tour medical officials reasonably consider advisable.
b) In a medical emergency, you consent to your personal information being shared with medical assistance personnel and the Tour organisers so they can help you.
6. Refunds, transfers and promotional codes
a) Other than as required by law (including the Consumer Guarantees Act 1993), tickets are non-refundable and cannot be exchanged, and transaction fees such as credit card and service fees are non-refundable. A change in your personal circumstances does not entitle you to a refund or to change your tour date or location, so please check the date and location carefully before you buy.
b) You may transfer your ticket to a family member or friend. To do this, update the name on the ticket through your booking account by 5:00pm (NZT) on the Wednesday before your tour date. The name on the ticket must match the photo ID the Tour goer presents on the day.
c) Entry may be refused if your ticket is damaged or defaced, was not bought through the Tours website, or if you cannot show acceptable photo ID (printed or digital, such as a passport or driver licence) that matches the name on the ticket.
d) Promotional codes may only be used by the person they were issued to, within their validity period, and where the conditions of the code are met. Promotional codes have no cash value and cannot be exchanged for cash. We may modify, suspend or cancel a promotional code at any time. No refund is available where you held a code but did not use it at the time of purchase.
7. Cancellation and rescheduling
a) We may cancel the Tours, for example because of dangerous conditions or a force majeure event (such as war, civil disturbance, natural disaster, epidemic or pandemic). If we cancel, we will tell Tour goers and, where possible, decide on and communicate a rescheduled date.
b) If a scheduled tour is affected by government-imposed restrictions, we will try to reschedule it. We will transfer Tour goers to the new date automatically, and you may choose to opt out.
c) If the Tours are cancelled or rescheduled, we will provide a refund where the law requires it, and may otherwise offer a refund at our discretion. We are not responsible for separate costs you incur (such as travel or accommodation booked separately) as a result, except to the extent the law requires otherwise.
8. Photos and media
We may take photographs, film and audio at the Tours. By attending, you consent to Stuff and its event partners collecting, publishing and using your name, image, voice or statements, in any media, for promotional, marketing and related purposes, without payment to you. If you do not wish to be filmed or photographed for these purposes, please let our staff know on the day and we will take reasonable steps to accommodate your request.
9. Your information and privacy
a) You confirm that the information you provide on the booking form is true and correct, and that you will update your contact details through your booking account if they change (and at least one week before the tour).
b) We collect your personal information to manage the Tours and your participation in them. We may share it with related Stuff companies and with our event partners and sponsors, and may use it to tell you about future events, products and services that may interest you. You can ask us not to use your information for marketing at any time.
c) You may access and correct the personal information we hold about you by emailing our Privacy Officer at privacy@stuff.co.nz. Our handling of your information is governed by Stuff Privacy Policy.
d) Your use of the Tours ticketing platform is subject to Stuff’s standard website terms and conditions.
10. Bookings for guests
If you book on behalf of guests, you must make each guest aware of these terms, and you confirm you have authority to buy tickets for them. We may cancel a booking where the booker did not have authority to buy on a guest’s behalf, or for other reasonable cause.
11. Age requirements
a) Children under 16, including babies and toddlers, may not attend the Tours under any circumstances.
b) Tour goers aged 16 or 17 must have a parent or legal guardian agree to these terms on their behalf. By agreeing to these terms for a person aged 16 or 17, you confirm you are their parent or legal guardian and that you accept these terms for them. If you are 18 or over, you are agreeing to these terms for yourself.
12. General
a) These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute relating to them or to the Tours.
b) If any part of these terms is found to be unenforceable, the rest of the terms continue to apply.
