Tickets Sales and Participation

  1. Stuff Limited (“Stuff”) organises and hosts the NZ House & Garden House Tours (“the Tours”). By purchasing a ticket(s) to participate in the Tours I(“the Tour goer” or “I” or “my” or “me”) acknowledge and agree that these terms and conditions (“Terms”) apply to my ticket purchase(s) and participation in the Tours and acknowledge that these terms and conditions may be subject to change from time to time at the discretion of Stuff without notice to the Tour goer.


    Agreement Waiver and Indemnity

  2. I declare that I am not aware of any illness, injury, physical disability or impairment which may cause me injury or death during or as a consequence of my attending the Tours.

  3. The decision to attend the Tours is entirely my own and I accept all risks associated with my attending the Tours, including but not limited to, loss of life or permanent injury. I agree to accept full responsibility to inform myself and assess all the dangers, hazards and risks of attending the Tours, and rely solely on my own assessment of these dangers, hazards and risks before attending the Tours and notwithstanding any decision made by the Tour organisers and other persons, corporations and bodies involved, engaged in promoting or staging the Tours.

    The following describe some, but not all, of the inherent risks of taking part in the Tour:
    Risks associated with the Event: Uneven ground or surfaces within homes and gardens on the Tour, as well as ruts, holes, rocks or other conditions may exist in and around the Tour.

    Personal health and participation risk: The risk of contracting communicable disease(s) from other person(s) including, but not limited to, other Tour goers; Stuff staff, representatives, volunteers or contractors; and/or any other person(s) before, during, and/or after the Tour and other activities.

    Supervision and activities risk: I understand that neither Stuff nor any of their staff, representatives, volunteers, contractors or anyone associated with them will be actively supervising Tour goers during the activities or at any time. Tour goers agree that they are solely responsible for their own well-being at all times.

    Equipment risk: The risk that equipment used on the Tour may be misused, or may break, fail or malfunction.

  4. To the fullest extent permitted by law, I release all persons or corporations associated directly or indirectly with the Tours from all claims, demands and proceedings arising out of my attending and I hereby indemnify such persons or corporations against all liability, loss or damage arising out of my attending the Tours, including any breach of these terms and conditions by me. This liability, loss or damage includes, but is not limited to, the cost to defend or settle any claim, suit, action or proceeding brought against Stuff. This release extends to and includes Stuff and its related companies, their respective directors, officers, agents, contractors, employees, promoters, sponsors and volunteers, including medical and paramedical personnel appointed for the Tours, the owners, licensees and occupiers of land upon which the Tours or any part of it takes place, any statutory body or local authority having control over any land upon which the Tours or any part of it takes place or which is involved directly or indirectly with the Tours in any manner whatsoever. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.

  5. All conditions and warranties which may be implied by law into these terms and conditions are excluded except to the extent that it would be unlawful to do so.

    Tour Rules and Regulations

  6. Tickets for the Tours are subject to availability and are available on a first come first served basis. Tickets can be purchased from www.nzhouseandgardentours.co.nz.

  7. I understand that Stuff reserves the right to change or modify any part of the Tours, including the date or location at any time, as well as the NZ House & Garden Tours website, and from time to time. Details of any such changes will be published via the Tours website, Tours e-newsletters and/or other means. Stuff will not be responsible for any costs incurred as a result of the Tours being modified. This includes but is not limited to ticket holders travel and accommodation, amongst others, which has been purchased separately to the Tour tickets.

  8. I acknowledge that Stuff or its representatives may remove me from the Tours and/or exclude me from entering any of the houses (a) if my behaviour is inappropriate, offensive, or abusive, (b) to prevent damage to any property, (c) on medical or health and safety grounds (including to prevent possible harm or injury to myself or any other person), or (d) to prevent or arrest any form of unauthorised marketing, including ambush marketing.

  9. As I will be visiting people’s homes as part of the Tours, I will need to be respectful and adhere to all instructions from event staff and volunteers. Stuff reserves the right to remove any Tour goers who do not adhere to instructions from volunteers or Stuff staff members. It may be a condition of entry to some of the homes that make up the Tour that a search of a person and / or their possessions will be required at the time of the entry and / or exit.

  10. Tour tickets may not, without the prior written consent of Stuff, be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket(s) is sold or used in breach of this condition, the ticket(s) may be cancelled without a refund and the bearer of the ticket(s) may be refused admission.

  11. I agree to abide by all Tour rules, terms and conditions. I understand that I must observe normal traffic rules and obey all directions and instructions given by Tour officials, event staff and volunteers. The Tour organisers reserve the right in their discretion to reject or cancel my attendance at any time, including without limitation for safety or insurance reasons. Stuff will not be obliged to refund any portion of the ticket price in such circumstances.

  12. I understand that under no circumstances are walking sticks, wheelchairs, walking frames, mobility scooters or other mobility aids, prams or other equipment, structure or accessories that may cause injury or damage to the Tour homes will be permitted inside the houses on the Tours. 

  13. I understand that no shoes must be worn inside the houses, except where Stuff has received written notice of a medical exemption prior to 5:00pm (NZT) on the Wednesday before each tour date. In the case of a medical exemption, I understand that shoe covers must be worn over my shoes and that these will not be provided to me by the Tour organisers.

  14. I understand that due to the personal nature of private homes on the Tours, no dogs are permitted at the Tours, including guide dogs for the vision impaired, service dogs for medical or disability requirements and working dogs involved in official demonstrations.

  15. I understand that taking photos inside the homes, the flying of drones and unmanned aerial vehicles (UAVs) by Tour goers is strictly prohibited without the written authorisation of Stuff. Such content may or may not be granted at Stuff’s sole discretion.


    Consent to Medical Assistance

  16. I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered direction of the Tour medical officials in the event of any injury, accident or illness to me during my attendance of Tours.

  17. I consent to the release of my personal information to medical assistance personnel and Tour organisers in the event of a medical emergency during my attendance at the Tours.

    Tour Entry, Refunds and Promotional Codes

  18. I understand that, as a general rule, ticket purchases are non-refundable and cannot be exchanged. No refunds will be issued for any tickets, subscriptions, donations or merchandise purchases, including where the Event is cancelled for any reason, except as required by law. Stuff will not be responsible for any costs incurred as a result of the Event being cancelled or rescheduled.

    Before purchasing tickets, Tour goers must carefully review the tour date and location. A change in personal circumstances does not entitle a ticket holder to a refund on any ticket(s) or to be able to change the tour date or location. Transaction fees, including but not limited to credit card fees and service fees, are also non-refundable. Ticket(s) are able to be transferred to a family member or friend. In this instance, it is the responsibility of the ticket purchaser to change the name(s) on the ticket(s) via their booking account by 5.00pm on the Wednesday before the Tour date. The name(s) on the ticket(s) must match the name on the Tour goers’ photo ID which they must show at their starting house on the day of the Tour.

  19. I understand that should my contact details change after my ticket purchase is completed, it is my responsibility to update this on my booking account no later than one week prior to the tour.

  20. I understand that entry may be refused if tickets are damaged or defaced in any way, or are not purchased via the NZ House & Garden Tours website.

  21. I understand that entry may be refused if I do not have an acceptable photo ID (printed or digital) that matches the name on my ticket i.e. passport or drivers licence.

  22. I understand that it may be a condition of entry that a search of a person and/or their possessions is required at the time of entry into the houses.

  23. Should the scheduled Tour dates be impacted by government imposed restrictions, Stuff will endeavour to reschedule the Tours to new dates. All Tour goers will automatically be transferred to new Tour dates, with the option to opt-out.

  24. I understand that promotional codes may only be used where a Tour goer meets the requirements/conditions applying to the code, including using the relevant code within the period of validity. Promotional codes cannot be redeemed or exchanged for cash and must only be used by the Tour goer(s) to whom the relevant code was issued to by Stuff, the event organiser.

  25. I understand that Stuff reserves the right to modify, suspend and/or cancel any promotional code(s) at any time without notice to Tour goers and that no refunds will be made to Tour goers who have access to a promotional code but did not use the code at the time of purchase.


    Consent to Media Coverage of Event

  26. I consent to the collection, publication and/or use in any form of media whatsoever of my name, image, video, voice, statement or otherwise, (including the publication of my name in any Stuff or Event partner publication both online and in print and/or on the Tours website, as well as Stuff partner platforms) for promotional, marketing or other purposes, without payment or compensation.


    Booking Form and Personal Information

  27. I declare that all the information supplied by me on the Tours booking form is true and correct.

  28. I consent to Stuff entering my personal details contained on the Tours booking form into the Tours database, which will be used for the administration of the Tours. Stuff collects personal information to manage participation in the Tours. Unless indicated otherwise, I agree that Stuff may disclose my personal information to Stuff related companies, business units and departments, including but not limited to the Tours event partners and sponsors, and may use the information for marketing future events, and other marketing and promotional purposes, including contacting Tour goers to offer products and services of potential interest to me.

  30. I understand that I can gain access to my personal information and request that such details be updated if they change in the future by writing to the Privacy Officer c|- Legal, Stuff Limited, PO Box 2595 Wellington.

  33. Ticket purchasers who submit a booking form on behalf of their guests undertake to make each guest aware of these terms and conditions. Stuff reserves the right to cancel any ticket purchase(s) at any time for any reason including, but not limited to, the ticket purchaser not having the requisite authority to purchase a ticket on behalf of their guest.

    Age Declaration

  34. I certify that I am 16 years or older, or that I am the parent/legal guardian of the Tour goer who is under the age of 18 years (but over 16 years), and I have read this document and fully understand it. As a parent or legal guardian, I agree to these terms and conditions for and on behalf of the Tour goer. 

    Children under the age of 16 years of age, including babies and toddlers, are not permitted to attend the Tours under any circumstance.


    Cancellation and Rescheduling of Event

  35. I understand that Stuff reserves the unfettered right to cancel the Tours at any time. Reasons for cancellation may include, but are not limited to, Stuff deciding in its sole discretion cancellation is required due to any sort of dangerous conditions and/or force majeure event (which may include,without limitation, war, civil disturbance, acts of God, epidemic or pandemic). In the event of cancellation, a ticket(s) refund may be applied at Stuff’s discretion and the cancelled Tour may not necessarily be rescheduled. Where possible, a decision will be made about a rescheduled date and communicated to Tour goers.

  36. Stuff will not be responsible for any costs incurred as a result of the Tour(s) being cancelled or rescheduled.
